The Montana state Supreme Court issued a ruling upholding the lower court’s stay on implementing the state’s ban on gender-affirming care for minors. The ruling is a pre-trial motion, but t does indicate a likelihood that those opposing the ban will prevail at the trial. NBC News has this story.
The U.S. House of Representatives voted to pass a military appropriations bill with an amendment which prohibits the use of this money to pay for gender-affirming care for members of the families of people in the military. This story comes from CNN.
The Advocate reports that more than 40 Senators oppose the provision denying funds for gender-affirming medical care. If the Senate does not keep the provision in its version of the bill, then a conference committee will have to settle the difference.
The United States Supreme Court declined an appeal to review a Wisconsin court decision which keeps a school district from informing a student’s parent or guardian if their child changes name or gender presentation at school. CNN has this story.
During last week’s oral arguments in United States v. Skrmetti, Chief Justice John Roberts seemed to take the stance that the justices are not medical experts, and therefore are unfit to overturn the law. This ignores the fact that the legislators who passed the law are not medical experts, nor are the voters who voted for those legislators. An article in Mother Jones suggests that this is a part of a plan to allow the states to limit transgender rights while limiting other attacks on civil rights.
President-elect Trump has chosen Harmeet Dhillon to be the Assistant Attorney General for Civil Rights. Ms. Dhillon is a far-right lawyer with a long record of opposing LGBTQ rights. A student at U.C.L.A., Kaya Breen, is suing her doctors and hospitals for medical negligence, saying that she was misdiagnosed with gender dysphoria and “fast-tracked onto the conveyor belt of irreversibly damaging puberty blockers, hormone replacement therapy, and surgery. While it is true that she is only 20 years old, which seems young to be post-operative, but the attitude of the patient is likely a component of that speed. While the article from NBC News does not specifically name a conservative legal group, it seems like it could be their handiwork.
