Lambda Legal and the Human Rights Campaign have filed a law suit on behalf of a group of transgender people who are serving in the military. They are challenging President Trump’s executive order banning transgender people from military service. ABC News has this story.
President Trump signed a new executive order, forbidding transgender women from participating in women’s or girls’ sports. This fulfills one of his campaign promises. This story comes from the Associated Press.
The NCAA.quickly announced a change in its policy on transgender athletes, to bring it into line with the new executive order.
The Department of Education is reportedly looking into colleges and universities which allowed transgender athletes to participate in women’s sports, for potential violations of Title IX, even though the interpretation of Title IX both by the NCAA and by the Department of Education at the time permitted transgender athletes to compete in women’s sports.
Transgender athletes in Virginia and Minnesota are still allowed to participate in girls’ sports, at least through twelfth grade. In both cases, state law says that transgender students can participate in sports activities according to their gender identities. The state of Washington is suing the Trump administration over its nationwide ban on gender-affirming care for those under 19 years of age. They are acting on behalf of Seattle Children’s Hospital and the transgender patients it serves. KUOW public radio has this story.

Skmetti, the case which was tried before the Supreme Court on the challenge that bans on gender-affirming medical care violate the Fourteenth Amendment’s equal protection clause. In a letter to the court, Deputy Solicitor General Curtis E. Gannon wrote, “Following the change in Administration, the Department of Justice has reconsidered the United States’ position in this case. Federal Judge Royce Lamberth has issued a stay to stop the federal Bureau of Prisons from moving three transgender prisoners or withholding their hormone replacement therapy. Because the three filed a class-action lawsuit, and because the judge believes that they are likely to be able to show that the president’s executive order is unconstitutional, the ruling actually applies to all sixteen transgender women currently in federal prisons. U.S. Representatives Mark Takano, Jamie Raskin, and Gerry Gonnolly sent a letter to the Office of Personnel Management, stating that they should not discriminate against transgender people. Their letter says that President Trump’s executive order saying that the government only recognizes two sexes violates the Constitution and goes against Supreme Court rulings.
